A Federal employee requested reconsideration of a Claims Division action denying him complete waiver of the Government's claim against him for the recovery of erroneous temporary lodging allowance payments he received incident to a transfer from the United States to Europe.
The employee had continued to receive temporary lodging allowance payments after he had moved into permanent. GAO can waive claims for overpayment of pay and allowances only if there is no indication of fraud, misrepresentation, fault, or lack of good faith on the part of the employee.
GAO considers that fault exists if it is determined that the employee should have known that the error existed and failed to take action to have it corrected.
